In this paper, we outline a framework for understanding the different kinds of knowledge required for medical practice and use this framework to show how scientism undermines aspects of this knowledge. The framework is based on Michael Polanyi’s claim that knowledge is primarily the product of the contemplations and convictions of persons and yet at the same time carries a sense of universality because it grasps at reality. Building on Polanyi’s ideas, we propose that knowledge can be described along two (...) intersecting “dimensions”: the tacit–explicit and the particular–general. These dimensions supersede the familiar “objective−subjective” dichotomy, as they more accurately describe the relationship between medical science and medical practice. Scientism, we argue, excludes tacit and particular knowledge and thereby distorts “clinical reality” and impairs medical practice and medical ethics. (shrink)

Viewed in its entirety, moral philosophizing, and the moral behavior of people throughout history, presents a curious puzzle. On the one hand, interpersonal duties display a remarkably stable core content: morality the world over enjoins people to keep their word; refrain from violence, theft and cheating; and help those in need. On the other hand, the asserted motives that drive people’s moral actions evince a dazzling diversity: from empathy or sympathy, to practical or prudential reason, to custom and honor, cultural (...) identity, excellence and independence, faith and spirituality, narrative and beauty, and more besides. I term this twin phenomenon—a core of fixed moral duties driven by diverse motives—“moral motive pluralism.” In this article, I marshal evidence to show the prevalence of the phenomenon. Contrary to widespread assumptions, across generations and cultures, diverse motives drive different people to perform their moral duties. But despite this diversity, each different motive impels conscientious compliance with the same core moral duties. I argue this phenomenon undermines key types of evidence commonly employed to justify popular moral philosophies, and provides us with reason to seriously consider certain sorts of ethical theories—especially “functionalist” accounts of morality. Schumacher’s work explores the various facets of theological anthropology in the first half of the thirteenth century by focusing primarily on scholars belonging to the Franciscan Order such as Philip the Chancellor, Alexander of Hales, and William of Auvergne, as well as early Dominican scholars such as Roland of Cremona and Hugh of St. Cher. Of central focus in the study is John of La Rochelle, whom the author notes “was the only member of his generation to deal robustly and comprehensively” with not only traditional questions on the soul but also matters of philosophy that had previously been considered beyond the purview of the theologian, topics that included the processes of the body and the psychological makeup of the human being. In addition, John was among the first to embrace the newly translated Arabic sources into his work, most notably the writings of Avicenna.The work is divided into eleven chapters, the first four of which provide a theological background on various authors and their views on the relation between the body and soul and the powers of the soul. The fifth and sixth chapters focus on two works of John of La Rochelle, the Tractatus and the Summa de anima, followed by a study of the reception of Averroes in the first half of the thirteenth century. The work concludes with chapters on the cognitive powers, the affections, free choice, and angels. Schumacher’s study is thorough, providing robust examinations of the individuals and topics, even those who are not central to the study, such as Roland of Cremona and Guerric of St. Quentin. [End Page 161]The book is well written and clearly elucidates the complex schemas of the topics at hand, particularly the nature of the intellect. This is particularly evident in the middle chapters, which examine the ideas of John of La Rochelle, in whose works one finds a multifaceted account of the human intellect. In addition, Schumacher notes an interesting facet of John’s view of cognition, according to which “the mind ‘predetermines’ or influences its understanding of the world.” Thus John’s theory of the act of human rationality, as Schumacher summarizes it, is “arguably achieved at the level of perception, and perception, in turn, is permeated and guided by reason’s quest to know the ‘thing in itself’ apart from matter.” John’s view is then briefly compared to that of William of Auvergne, who argued that perception is “virtually irrelevant” for human understanding. This comparison underscores the rifts that took place during the development of early thirteenth-century thought regarding the nature and function of the intellect as it underwent a profound change from traditionally Augustinian ideas to attempts to reconcile the former with the ideas found in the newly available works of Aristotle and his Arab commentators, namely, Avicenna.The only criticism one might have is that, at times, the chapters seem out of order. For example, after the two chapters that deal extensively with the works of John of La Rochelle, the following chapter is “The Reception of Averroes in Early Scholasticism,” which examines the possible sources “of the three-fold intellectual schema” that is found in John of La Rochelle’s works. Possible sources include not only Averroes but also Aristotle and Alexander of Aphrodisias, as well as two anonymous works that John knew and utilized. The chapter itself is presented effectively but makes the work feel somewhat disjointed. Natural property rights are widely viewed as anathema to welfarist taxation, and are pictured as non-contextual, non-relational and resistant to regulation. Here, I argue that many of the major arguments for such views are flawed. Such arguments trade on an ambiguity in the term ‘right’ that makes it possible to conflate the core concept of a right with a situated or specified right from which one can read off people’s actual legal entitlements and duties. I marshal several arguments demonstrating this (...) conflation. In particular, I examine the right to free speech, where contextualization and responsiveness to the requirements of other rights are assumed as a matter of course. I conclude that the existence of one natural right does not foreclose the existence of other natural rights. Arguments for or against welfare rights must be assessed, at least to some extent, independently of the assertion of a natural property right. (shrink)

Ethical dilemmas involving tax issues were identified by members of the American Institute of Certified Public Accountants as posing the most difficult ethical problem for them (Finn et al., Journal of Business Ethics 7(8), pp. 607–609, 1988). The KPMG tax shelter fraud case proves that the tax profession has not gone untainted in the age of numerous accounting and corporate scandals, such as the Enron débâcle (Sikka and Hampton, Accounting Forum 29(3), 325–343, 2005). High-profile scandals serve to highlight the problems (...) caused by differences in ethical judgement among accountants and tax practitioners and the issue of ethics has been brought publicly to the forefront of the profession. Nevertheless, the nature and dimension of ethical issues in tax practice have been largely unexplored (Erard, Journal of Public Economics 52(2), 163–197, 1993; Marshall et al., Journal of Business Ethics 17(12), 1265–1279, 1998; Frecknall Hughes, Unpublished PhD Thesis, The University of Leeds, 2002). This research aims to contribute to the debate on ethics in tax practice by reporting interview data on tax practitioners’ perceptions of ethics in the jurisdictions of Ireland and the United Kingdom and exploring the link or equation of ethics with risk management. In this essay I shall argue that the state should require all parents to be licensed. My main goal is to demonstrate that the licensing of parents is theoretically desirable, though I shall also argue that a workable and just licensing program actually could be established.

It is often maintained that, since the buying and selling of organs—particularly the kidneys—of living people supposedly constitutes exploitation of the living vendors while the so-called “altruistic” donation of them does not, the former, unlike the latter, should be a crime. This paper challenges and rejects this view. A novel account of exploitation, influenced by but different from those of Zwolinski and Wertheimer and of Wilkinson, is developed. Exploitation is seen as a sort of injustice. A distinction is made between (...) justice and fairness. To exploit someone is to take advantage of him or her unjustly. Exploitation pertains to the nature of actions, interactions, and transaction rather than to their outcomes or to how they are perceived by exploitees. Desperation on the part of one or other of the parties to a transaction does not preclude the giving of valid consent to the transaction. Disparities of power or wealth between the parties to a transaction do not indicate or entail that the transaction will be exploitative. A disparity in the benefits that arise from a transaction between the parties does not indicate or entail that exploitation has taken place. (shrink)

Recent empirical work calls into question the so-called Simple View that an agent who A’s intentionally intends to A. In experimental studies, ordinary speakers frequently assent to claims that, in certain cases, agents who knowingly behave wrongly intentionally bring about the harm they do; yet the speakers tend to deny that it was the intention of those agents to cause the harm. This paper reports two additional studies that at first appear to support the original ones, but argues that in (...) fact, the evidence of all the studies considered is best understood in terms of the Simple View. This book offers a ground-up defense of objective morality, drawing inspiration from a wide range of philosophers, including John Locke, Arthur Schopenhauer, Iris Murdoch, Nel Noddings, and David Lewis. The core claim is compassion is our capacity to perceive other creatures' pains, pleasures, and desires. Non-compassionate people are therefore perceptually lacking, regardless of how much factual knowledge they might have. Marshall argues that people who do have this form of compassion thereby fit a familiar paradigm of moral goodness. His (...) argument involves the identification of an epistemic good which Marshall dubs "being in touch". To be in touch with some property of a thing requires experiencing it in a way that reveals that property - that is, experiencing it as it is in itself. Only compassion, Marshall argues, lets us be in touch with others' motivational mental properties. -/- This conclusion about compassion has two important metaethical consequences. First, it generates an answer to the question ";Why be moral?", which has been a central philosophical concern since Plato. Second, it provides the keystone for a novel form of moral realism. This form of moral realism has a distinctive set of virtues: it is anti-relativist, naturalist, and able to identify a necessary connection between moral representation and motivation. This article offers an account of the information condition on morally valid consent in the context of sexual relations. The account is grounded in rights. It holds that a person has a sufficient amount of information to give morally valid consent if, and only if, she has all the information to which she has a claim-right. A person has a claim-right to a piece of information if, and only if, a. it concerns a deal-breaker for her; b. it does not (...) concern something that her partner has a strong interest in protecting from scrutiny, sufficient to generate a privilege-right; c.i. her partner is aware of the information to which her deal-breaker applies; or c.ii. her partner ought to be held responsible for the fact that he is not aware of the information to which her deal-breaker applies; and finally, d. she has not waived or forfeited her claim-right. Although we present this account in the context of sexual relations, we believe a virtue of the account is that it can be easily translated into other contexts. (shrink)

This paper is concerned with the problem of giving a correct analysis of function statements as they are used in biology. Examples of such statements are (1) The function of the myelin sheath is to insulate the nerve fiber and (2) The function of chlorophyll is to enable photosynthesis to take place. After criticizing analyses of such statements developed by Braithwaite, Nagel and Hempel an analysis is presented by the author. It is a little understood fact that the system of formal logic presented in Wittgenstein?s Tractatusprovides the basis for an alternative general semantics for a predicate calculus that is consistent and coherent, essentially independent of the metaphysics of logical atomism, and philosophically illuminating in its own right. The purpose of this paper is threefold: to describe the general characteristics of a Tractarian-style semantics, to defend the Tractatus system against the charge of expressive incompleteness as levelled by Robert Fogelin, and to (...) give a semantics for a formal language that is the Tractarian equivalent of a first-order predicate calculus. Of note in regard to the latter is the fact that a Tractatusstyle truth-definition makes no appeal to the technical trick of defining truth in terms of the satisfaction of predicates by infinite sequences of objects, yet is materially equivalent to the usual Tarski-style truth-definitions. The modern problematic, defined by Kenneth Schmitz, is a widespread acceptance of God’s absence in the culture of the technologically advanced Western societies. Schmitz clearly has been deeply influenced by Karol Wojtyla’s work as both philosopher and religious leader. Pope John Paul II’s Fides et Ratio is notable for its courage in advocating the serious pursuit of truth guided at least in part by the philosophy of being. This essay draws on certain important contrasts in Schmitz’s subsequent meditations upon the (...) transcendental of beauty and its implications for communication and postmodern culture with its emphasis on the human subject. The purpose is to reflect on the special significance of this important contrast, shift, and development that occurs in these aspects of Schmitz’s own philosophy within the tradition of the philosophy of being that has been given renewed definition and importance for our challenging times in John Paul II’s encyclical on faith and reason. The book also stresses basic ethical principles and includes a chapter with numerous cases for discussion. An excellent teaching tool!

Discusses the relationship between God and morality. I argue that the most satisfying view identifies the will of God with the basic facts about goodness. This, I claim, yields an abstract conception of God, according to which to say that the world exists because it is good is to say that it was created by God. I argue further that God, so conceived, can be thought of, not only as the creator of the world, but as reacting to the world, (...) as possessing knowledge, and as loving. Research consent processes must provide potential participants with the necessary information to help them decide if they wish to join a study. On the Oxford ‘A’ Research Ethics Committee we’ve found that current research proposals mostly provide adequate detail (even if not in an easily comprehensible format), but often fail to support decision making, a view supported by published evidence. In a previous paper, we described how consent might be structured, and here we develop the concept of an Information and (...) Decision Aid (IDA) that can support decision making and be used to guide the dialogue between researcher and potential participant. Our proposal requires limited changes to current processes or paperwork and would provide an easily accessible document for others that the potential participant might approach for advice. It could later be integrated with the Informed Consent Form to ensure all matters of concern to the individual participant have been addressed before consent is formally signed off. (shrink)
